I. Introduction

This application is operated by Mediatech S.R.L., a limited liability company organized and operating under the laws of Romania, a Romanian legal entity, with its registered office in Hațeg, Ion Luca Caragiale Street, no. 2, Hunedoara County, registered with the Trade Registry attached to the Hunedoara Tribunal under no. J20/586/1996, unique registration code 8605210 (hereinafter referred to as "SHNUR"), and e-mail address: hello@shnur.app.

This document sets forth the terms and conditions for using this Application and the scheduling conditions through this Application (hereinafter referred to as "Terms and Conditions"). These Terms and Conditions constitute the legal agreement between you and Mediatech S.R.L.

Accessing and visiting the Application, registering an account on the Application, and/or using the Application’s services for publishing ads for selling, buying, or renting goods or services (the "Services") implies full and unconditional acceptance of these Terms and Conditions.

Please read these Terms and Conditions carefully before using this Application and performing any operation through it.

If you do not agree with these Terms and Conditions, please do not use this Application.

By agreeing to these Terms and Conditions, you declare and guarantee that you are at least 18 years old and have full legal capacity or, in the case of a legal entity, that you are a company registered and operating under Romanian law, and that your representatives are duly authorized to express your legal agreement regarding accessing, visiting, or using in any way the Application and/or the Services.

If you do not delete the account registered on the Application, it means that you have expressed your legal agreement regarding the modification of the Terms and Conditions. If you do not agree with the proposed modifications, your only option is to delete your registered account on the Application or to no longer access, visit, or use the Application in any way.

The Privacy Policy, the Cookie Policy, as well as any other policies or documents referred to in this document, form part of these Terms and Conditions. By accepting the Terms and Conditions, you also agree with SHNUR’s Privacy Policy, as well as with all other policies, online guidelines, and all applicable laws and regulations.

SHNUR reserves the right to modify or update the Terms and Conditions at any time, unilaterally. Any modifications to the Terms and Conditions will only apply to new accesses or visits to the Application recorded after the publication of the respective changes on this Application. Therefore, please check the “Terms and Conditions” section before each operation, as changes may have occurred since your last visit.

In case of any conflict between these SHNUR Terms and Conditions and other supplementary or special Terms and Conditions present on the Application, the supplementary and special Terms and Conditions will prevail.

The purpose of these Terms and Conditions is to define and regulate the conditions for using the Application and the Services.

II. Definitions

Within these Terms and Conditions, the following terms shall have the meanings set out below:

COOKIE – means a small file, generally made up of letters and numbers, that is downloaded to a computer’s memory (or another device used for online browsing – mobile phone, tablet, etc.) when the user accesses the Application, used to ensure a faster and easier interaction between users and the web Application.
PERSONAL DATA – any information relating to an identified or identifiable natural person; an identifiable person is one who can be identified, directly or indirectly, in particular by reference to an identification number or to one or more factors specific to their physical, physiological, mental, economic, cultural, or social identity.
PROVIDER OR SHNUR – Mediatech S.R.L., a Romanian legal entity, headquartered in Hațeg, Ion Luca Caragiale Street, no. 2, Hunedoara County, registered with the Trade Registry attached to the Hunedoara Tribunal under no. J20/586/1996, VAT code RO8605210, share capital: 200 lei.
LINK – means a reference, connection, or navigation element in an electronic document to other parts of the same document, other documents, or sections from other documents, to which a user is directed when accessing the navigation element.
NEWSLETTER – a periodic bulletin communicated by SHNUR to its users who have explicitly consented to receive such communications, containing news, information about activities, projects, updates, and services provided by SHNUR, intended for its users.
SPAM – means any unsolicited commercial communication prohibited by law as long as there is no explicit consent of the recipient (the user). SHNUR does not encourage SPAM and will not engage in such communications with its users.
STORAGE – storing data or information on any type of support.
USER – any natural person at least 18 years old, with full legal capacity, who accesses the Application, being interested in the data, information, ads, and/or SHNUR Services, as well as any natural person (including authorized individuals) and/or legal entity that purchases the Services provided through the Application.
VISIT – any access by a person to the Application or one of its subsections.
PROCESSING OF PERSONAL DATA – any operation or set of operations performed upon personal data, by automated or non-automated means, such as collection, recording, organization, storage, adaptation, modification, retrieval, consultation, use, disclosure to third parties through transmission, dissemination, or otherwise making available, alignment or combination, blocking, erasure, or destruction.
SHNUR PAGE / SHNUR APPLICATION – the SHNUR Application, including any section or subpage thereof. Applications and/or web pages or other components belonging to third parties accessed by Users as a result of links available on the SHNUR Application are not subject to nor fall within the scope of this definition.
ANNOUNCEMENT – a public offer launched by a User to be published by SHNUR through the Application regarding the sale or rental of a Product.
PRODUCT – a good or service that can be legally marketed and that does not violate the restrictions imposed by these Terms and Conditions.
FREE ANNOUNCEMENT – an announcement that can be published by Users on the SHNUR Application without any fee charged by the Provider.
OPERATORS – persons specially trained by the Provider to verify/moderate the content of Announcements published by Users on the Application.

III. Intellectual Property Rights

The content of the Application, including, but not limited to, texts, images, trademarks, logos, graphics, animations, software, and other similar elements (hereinafter referred to as "Content") is protected by intellectual property rights belonging to SHNUR or its partners.

You may not copy, reproduce, republish, upload, post, transmit, or distribute in any way the Content of this Application, including texts, images, graphics, logos, or other elements, without the prior written consent of SHNUR.

Any unauthorized use of the Content constitutes a violation of copyright and other intellectual property rights, and will result in the application of legal consequences.

IV. Purpose of the Application

The Application allows Users to publish ads for selling, buying, or renting Products, as well as to access other related Services offered by SHNUR.

The Application acts solely as an intermediary between Users and does not assume responsibility for:

the existence, quality, safety, or legality of the Products published in ads;
the truthfulness or accuracy of the content of the ads;
the ability of Users to sell or buy Products.

Users understand and accept that SHNUR does not guarantee in any way the conclusion and/or performance of transactions resulting from the ads published on the Application.

V. Conditions of Use

To use the Services offered by SHNUR, Users must create an account in the Application by providing the required information.

Users are responsible for:

the accuracy, correctness, and timeliness of the data provided;
keeping the confidentiality of their authentication data (username and password);
all activities carried out through their account.

It is forbidden to use the Application for:

publishing ads containing offensive, discriminatory, illegal, or immoral content;
publishing Products that are counterfeit, stolen, or prohibited by law;
sending spam, chain letters, or other unauthorized communications;
attempting to gain unauthorized access to the Application, servers, or networks connected to it.

Violation of these conditions gives SHNUR the right to suspend or delete the User's account, without prior notice, and to block access to the Services.

VI. Publication of Ads

To publish an ad, Users must fill in the required fields and provide accurate, complete, and up-to-date information regarding the Product offered.

The ad must comply with the following rules:

the title and description must be clear, accurate, and correspond to the Product offered;
the photos uploaded must be real and relevant to the Product;
the Product must be legal and not fall into the categories prohibited by SHNUR’s policies.

SHNUR reserves the right to refuse or remove any ad that violates these Terms and Conditions or is considered inappropriate.

VII. Liability of SHNUR

SHNUR does not guarantee that the Application will function uninterrupted, error-free, or free of viruses or other harmful components.

SHNUR is not responsible for:

losses, damages, or prejudices resulting from the use or inability to use the Application;
the content of ads published by Users;
disputes between Users, including but not limited to, those related to the conclusion, performance, or termination of transactions initiated through the Application.

Users agree to indemnify and hold SHNUR harmless against any claims, demands, damages, losses, costs, or expenses arising from their violation of these Terms and Conditions.

VIII. Payments

Certain Services offered through the Application may be subject to fees.

Fees will be displayed transparently before the User chooses to purchase the Service.
Payments are processed through authorized third-party payment processors.
SHNUR does not store Users' payment information.

All payments are final and non-refundable, unless otherwise stated by applicable law.

IX. Termination of Services

SHNUR reserves the right to suspend or terminate a User’s access to the Application and its Services at any time, without prior notice, if the User:

violates these Terms and Conditions;
engages in fraudulent or abusive activity;
publishes prohibited or illegal content.

Users may also request the deletion of their account at any time by following the instructions provided in the Application.

X. Privacy Policy

The processing of personal data is carried out in accordance with applicable legal provisions and SHNUR’s Privacy Policy, which is available in the Application.

By using the Application, Users consent to the collection and processing of their personal data as described in the Privacy Policy.

XI. Changes to the Terms and Conditions

SHNUR reserves the right to modify these Terms and Conditions at any time.

The updated version will be published in the Application and will take effect from the date of publication.
Continued use of the Application after the publication of changes constitutes acceptance of the new Terms and Conditions.

XII. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of Romania.

Any disputes arising in connection with the use of the Application will be resolved amicably. If an amicable settlement is not possible, disputes will be submitted to the competent courts in Romania.
